Terms of service
Plain terms: what we do, what we commit to, what we don’t promise, and what we need from you.
About these terms.
These terms apply to this website and to services from Wide Open Digital, 67 Armonim St., Kiryat Yam, Israel.
A signed quote or order may add terms for a specific project; if they differ, the quote wins.
The site scan.
The site scan report costs $29.
The site does not take payments: after you send the scan form we email you a payment link, and we run the scan once it is paid.
The scan is an automated check with no obligation to order anything else.
Its result is an indication only: it does not find every issue, and it is not an audit or a statement that a site is accessible.
Quotes and payment.
Audits and fixes are priced by personal quote; there is no price list.
The quote states the price, the scope, what is included, the timeline, the payment terms and how long the quote is valid.
If it includes ongoing monitoring, it also states the monthly price, the minimum period and how to end it.
The accessibility menu add-on has the fixed prices shown on the pricing page.
It is a comfort tool and is not part of an audit or fix. Add-on prices · See how it works
If you are a consumer, your rights under consumer protection law, including any right to cancel, are not limited by these terms.
Cancellation and ending a subscription.
Good to know about the accessibility menu subscription. The monthly plan renews every month until you cancel, without advance notice before the end of a period. The annual plan ends at the end of the paid year. You can cancel at any time and in any way, with no cancellation fee.
Ways to cancel: by email to wideopendigitalteam (at) gmail.com, by phone at +972-54-660-7314, by registered mail to 67 Armonim St., Kiryat Yam, Israel, or in the same way you signed up. Please include your name and your ID or business number. We will confirm in writing that we received it.
After you cancel, the menu stays active on your site until the end of the paid period. At the end of that period we remove it from our side, and you will not be charged again.
If you are a consumer, your rights under consumer protection law prevail, including, where Israeli law applies, section 13D of the Consumer Protection Law, 5741-1981. Under that section, the subscription ends within three business days of your cancellation notice, or six business days from posting if you send it by registered mail, unless your notice names a later date, such as the end of the paid period. On that date we stop the service, and we will not charge you for any service after it.
Where Israeli law applies, a consumer's right to cancel a distance sale is as set out in section 14C of that law and the regulations under it, and for a person with a disability, a senior citizen or a new immigrant, also in section 14C1. Any refund in that case, including of the setup fee, is made as set out in section 14E.
Accessibility menu: failed payment, switching off and back on.
The menu loads on your site from our servers, so we can switch it on and off remotely. We switch it off only if you cancel, if a payment fails and is not settled, if a period ends with no renewal and no cancellation, or if the law requires it.
If a payment fails, we will tell you in writing. The menu keeps working for 14 days from that notice, and it is never switched off before the end of a period you have paid for. If payment is not made by then, we switch the menu off from our side.
If a period ends with no renewal recorded and no cancellation, the menu keeps working for 3 more days while we look into it with you.
Switching it off does not affect the rest of your site. Once you pay, the menu comes back on by itself within minutes at no extra cost. We do not charge you while it is off. An outage on our side does not switch it off. To pay, you can contact us in any of the ways in the previous section.
The menu and your accessibility statement. The menu is an extra convenience tool. It does not replace meeting accessibility law and standards, and it is not required to meet them. If your accessibility statement mentions the menu, update it when your subscription ends or the menu is switched off.
If you are a consumer, your rights under consumer protection law prevail, including, where Israeli law applies, section 13B2 of the Consumer Protection Law, 5741-1981.
Our guarantee at delivery.
At delivery, every page in your report meets each WCAG 2.1 AA criterion we tested. If one is found unmet on those pages, we fix it free.
Our target is WCAG 2.2. The minimum we commit to is WCAG 2.1 Level AA.
What the commitment covers, and what it does not:
- It covers the pages listed in your audit report, as they are on the delivery date.
- Pages we did not audit are not covered.
- Changes made to the site after delivery are covered only under the subscription or the re-fix terms in your quote.
- It is a promise about our work. It is not legal advice, and it is not a promise of protection from claims or lawsuits.
Fixes we make live in your code and stay yours if you stop working with us.
If an issue we fixed comes back within two months of delivery, we fix it again for free; if it came back because of changes made after delivery, the re-fix is covered under the subscription or the re-fix terms in your quote.
The quote states the period and details of the re-fix terms.
What we promise, and what we don’t.
- We do the agreed work carefully and professionally, and report honestly on what is fixed and what is still open.
- Apart from the commitment at delivery above, we do not promise that a site is or will remain compliant. We do not give legal advice, and we do not promise immunity from claims or protection from lawsuits. Sites change, standards are interpreted, and third-party parts are outside our control.
- Content and changes added to your site after the project are your responsibility, unless they are covered by a subscription.
Your part.
You give us the access and information the work needs, confirm that you may give it, and keep your own backups.
You remain the operator of your site and responsible for it.
Liability and governing law.
To the extent the law allows, our liability for a service is limited to the amount you paid for it.
Israeli law applies, and the courts of Haifa, Israel have jurisdiction.
